The proposed Variance is for a 12-foot x 14 Foot addition for Jeffrey Beatty Tax map # 93.02-1-18 on State Route 23, Town of Ashland. The Hearing will be scheduled for August 12, 2024, 7:30 PM at The Town Hall #12094 State Route 23, Ashland, New York. All parties will be heard at that time. Supervisor Tompkins asked if Dawn received the Return receipts from him, which she did. He is looking for an 18-foot Variance at the back of his building to the property line for an additional mechanical room on the back of his house. He went over his plans and the options for property with the board. He stated it would look better on the back of the house, and seemed to fit will with the structure. 5]After review; A motion to close the public hearing, at 7:40 PM made by Councilperson James Garraghan, seconded by Councilperson John Mattice, all in favor. 6] Public Hearing Proposed Variance Space Storage LLC: At 7:41 PM a Motion made to open the Public Hearing by Councilperson Jeff Gonzalez, seconded by Councilperson James Garraghan, all in favor. Notice is hereby given: A Public Hearing will be held to consider a proposed Variance for additional storage units at 11241, regarding set back in the Town of Ashland. The proposed Variance is for Space Storage LLC., Tax map # 94.00-2-45 on State Route 23, Town of Ashland. The Hearing will be scheduled for August 12, 2024, 7:30 PM at The Town Hall, 12094 State Route 23, Ashland, New York. All parties will be heard at that time. A motion made Councilperson Jeff Gonzalez, seconded by Councilperson James Garraghan, to approve the 18-foot variance of Mr. Beatty, motion was; Adopted: Aye-5 Tompkins- Tuttle- Gonzalez- Garraghan- Mattice Nay-0 A motion by Councilperson James Garraghan to approve the variance for Space Storage LLC of 20 feet on the west and 37 feet on the south, seconded by Councilperson John Mattice, motion was; Adopted: Aye-5 Tompkins- Tuttle- Gonzalez- Garraghan- Mattice Nay-0 8] Magda Lane Engineering Review: The board members received Doug VanDuser report from Lamont for Magda Lane, after a discussion and clarification with the Town Attorney Tal Rappleyea via phone: A motion by Councilperson Scott Tuttle to accept the report on Magda Lane, seconded by Councilperson Jeff Gonzalez, motion was; Adopted: Aye-5 Tompkins- Tuttle- Gonzalez- Garraghan- Mattice Nay-0 9] Stamped Plans for Ambulance Quarters Update: The Supervisor advised the board with the cost of the quarters upstairs being a certain amount, we need to have stamped plans in place, which are in the works. 10] Generator Issues: The Supervisor reported to the board, that our Generac generator system was not working properly- during the electric outage for several days. He and Travis were working on it, and enlisted others to figure out what they could do to solve the issues . 11] NYSEG OUTAGE: There were numerous calls to the Supervisor regarding the outage, many young and older people were without power for 2-3 days. People with no refrigeration for food. We are encouraging people to contact the Public Service Commission, make them aware of this long outage, and people affected. Many residents out of power for several days, did not see NYSEG check the roads they resided on. 12] Water Main Extension- Drilling update, and JAT installing three fire Hydrants on the South side of Route 23, each flushing hydrant will be on the North side of route 23. DEP pulled the permit and it is to be reinstated momentarily, but has not happened yet. NYS gave their permit. The cost for the hydrants will be $5950.00 each. 13] ARPA Money from Greene County: The information was sent to the county regarding a veteran Memorial Flag area and a pickle ball court. Motion by Councilperson James Garraghan, to draft the resolution for a multi-use, court using the basketball court and pickle ball court, and the Veteran’s memorial, seconded by Councilperson Scott Tuttle, motion was; Adopted: Aye-5 Tompkins- Tuttle- Gonzalez- Garraghan- Mattice Nay-0 14] Ambulance Fees Collected: The board members reviewed and signed the report. 15]Multitimed Billing Service, Inc.-The board discussed using this service for all the new updated billing numbers and work involved with the ambulance service. This service will receive approximately 12% of the amount taken in. After they discussed the variables involved with this undertaking and working with this company. A motion to authorize the new billing system made by Councilperson John Mattice, seconded by Councilperson James Garraghan, motion was; Adopted: Aye-5 Tompkins- Tuttle- Gonzalez- Garraghan- Mattice Nay-0 3]Comments From the Floor: Travis returned to the meeting- he checked the sewer line and easement regarding Beatty’s Property. He wanted the board to make sure the easement and building would not be in either the line or easement. After the board discussed the possibility, The Supervisor -Code enforcement officer and Travis agreed to meet and check the area. They stated we may have to contact Kevin Young or Tal on this. 16] Town Board resolutions #34-38: TB Res.#34: Annual Water Usages Billing 2024: Motion to accept the amount of $23,842.00 consisting of 91 hookups made by Councilperson Scott Tuttle, seconded by Councilperson John Mattice, motion was; Adopted: Aye-5 Tompkins- Tuttle- Gonzalez- Garraghan- Mattice Nay-0 TB Res.#35: Town of Ashland wishes to install a flag pole for future Veteran’s Memorial, a Pickle Ball court on existing Basket Ball court, at the Town Park, with ARPA funds from Greene County in the amount of $25,000. PRESENT: Rich Tompkins---------- Supervisor James Garraghan ----------Councilperson Jeffrey Gonzalez-------- Councilperson John Mattice---------Councilperson Scott Tuttle----------------Councilperson Heather Younes----------Deputy Clerk/Collector 1)Pledge to the Flag and Supervisor Richard Tompkins called the meeting to order at 7:33pm. With Louise LeBrun from the general public. 2)Comments from The Floor No comments from the floor. 3)Louise LeBrun -Ms. LeBrun approached the Ashland Town Board for a proposed Historic Marker for the North Settlement United Methodist Episcopal Church that was built in 1826 and is located at 2184 County Route 10 in Ashland, New York 12407. Francis Burns was the first African- American Missionary Bishop of the United Methodist Episcopal Church. In 1996 the church was placed on the National Register of Historic Places, and was also listed on the Greene County Historical register. Ms. LeBrun is filling out an application for a Historic Marker Grant and wanted to approach the Town Board because it’s the municipal responsibility to maintain and take care of the markers before she proceeds. When she applies for the grant, it will pay for everything except the pole. A price sheet was provided from Catskill Castings. 4) BAR REAPPOINTMENT- A motion was made by Mattice with a seconded by Gonzalez for the 5-year term reappointment of Gail Donahue. All in Favor. 5) AMBULANCE WRITEOFFS- A motion was made by Tuttle with a seconded by Garraghan to accept the Ambulance fees and write off collateral report. Motion approved. All in favor 6)Adopt General Fund Resolution #5- Supervisor offered the following resolution of 2024 to balance accounts in 2024 and moved its adoption, to transfer from Unappropriated Fund Balance and transferred to Town Clerk for postage and Employee Benefits Worker’s Comp. A motion was made Tuttle with a seconded by Gonzalez. All members are in favor. 7)Adopt Sewer Fund Resolution #3- Supervisor offered the following resolution of 2024 to balance accounts in 2024 and moved its adoption in the Sewer District. Transferred from Unappropriated Fund Balance transferred to Sewage Collecting System. A motion was approved by Gonzalez with a seconded by Mattice. All members are in favor. 8) Adopt Town Board Resolution #18- Supervisor offered the following resolution of 2024 to balance funds in the 2024 at the Town Board Meeting and moved its adoption. To authorize the use of sum of $187,595.75 from the General Fund Unappropriated Fund balance to balance accounts for 2024 in the General Fund. To adjust the General Fund Budget, the Town Board has increased revenues in the Appropriated Fund Balance Account, and increased the Appropriation Account for the expense in the amount mentioned above. A motion was made by Tuttle with a seconded by Garraghan. All members are in favor. 9) Adopt Town Board Resolution #19- Supervisor offered the following resolution of 2024 to balance funds in the 2024 at the Town Board Meeting and moved its adoption. To authorize the Supervisor to use the sum of $3,200.00 from the Sewer District Fund Unappropriated Fund Balance to balance accounts for 2024 in the Sewer District. To adjust the sewer District Budget, The Town Board has increased revenues in the Appropriated Fund Balance Account, and also increased the Appropriation Account for the expense in the amount mentioned above. A motion was made by Gonzalez with a seconded by Mattice. All in favor. 10) MONTHLY REPORT FROM TOWN CLERK A motion was made by Mattice to accept February 2024 monthly report with a seconded by Garraghan. All in Favor 11) Communication- A. CWC Ballot for the Board of Directors Election was signed for and must be postmarked by March 18, 2024. B. NYSEG Funded EV Charging Station Program was discussed and the board members are not interested at this time. C. Invitation was mentioned about attending the Schoharie Water Summit for different topics that will be discussed and a chance to gain credits for those that needs credits. D. Thank you notes were received from River Valley Radio for doing business with them. Thank You notes were also received for the ambulance in memory of a patient. E. Ashland WWTP Monthly report for February 2024 was reviewed. 12) Ambulance contracts- were looked over again and needs to go back to the Town attorney for corrections. Supervisor asked for a motion to sign the contracts on the boards behalf when the contract is presented the way they want it. A motion was made by Garraghan with a seconded by Tuttle. All in favor . 13) Review and Decide on Health Insurance Plans- Board members looked over different health insurance plans. Board members have decided on two separate plans for the employees to have the option to pick which is better for them. Board members also discussed dental and vison plans for the employee to pay full premium. A motion was made by Tuttle with a seconded by Gonzalez. All in Favor. 12) Amendment to February minutes- Supervisor asked for a motion on an amendment to February 12, 2024 minutes for Thomas Mattice pay increase to match Jordan Braren and Timothy Gonzalez and retroactive to the 1 st payroll in March. A motion was made by Tuttle with a seconded by Mattice. All in favor. 13) PAY THE BILLS Warrant #3 General $134,127.46 Warrant #3 10 Highway $4,479.26 Warrant #3 WWTP $8,329.44 Warrant #3 Water $ 2,101.98 Warrant #3 Street Lighting $173.23 Warrant #3 Ambulance District $33,016.29 A motion was made by Garraghan to pay the bills as written, seconded by Mattice. Town of Ashland, Greene County, New York Public Notice: Hearing on Joe Clark -TM # 77.04-1-11 at 115 North Settlement Rd., Ashland, NY Public Hearing is for a proposed variance on a septic that only has 10 feet from property line. Proposed project does not meet the Structure Ordinance in the town of Ashland. Notice is hereby given; that the public hearing will be held by Ashland Town Board at 12094 State Route 23, Ashland NY on October 14, 2024 at 7:30pm. Said hearing shall give towns and residents an opportunity to notify the landowner of concerns related to the proposed project. All persons interested in this matter will be heard at such time, date, and place. Specified. By Order of the Town Board, Heather Younes, Deputy Town Clerk-Dated: October 2, 2024 Tal Rappleyea -Doug Van Deusen – Mr. Utter and the parties involved with this project had discussed prior to the meeting, options available for this septic project. Tal explained the original plans to the side, moving it as far back as they can. Doug agreed, it will meet DOH and comply with DEP deeper in the property. It is away from the well on the property. 2-3] Close Public Hearing: Motion by Councilperson Jim Garraghan, seconded by Councilperson John Mattice to close this public hearing and move to the second public hearing at 7:54 – motion carried. Notice is Hereby Given: A Public Hearing will be held to consider a proposed variance for a septic regarding setback in the Town of Ashland. The proposed variance of a septic system is for Mr. Wm. Bonacci of Deer run Road, Town of Ashland, Tap Map# 76.00-2-23. Mr. Bonacci is asking for 30 feet on the Northern boundary and 23 feet on the westerly Boundary. The hearing will be scheduled for October 14th, 2024 – 7:30PM at the Town Hall 12094 State Route 23, Ashland, New York. All parties will be heard at that time. Mr. Bonacci brought his architectural plans to the meeting with his mailings to neighboring property owners, for the Town Clerk. He is looking to build a new house and septic, he has the DEP approved documents- which were reviewed by the board, discussion was regarding the topography and elevation and location of well and footage. 4-5] A motion to close the public hearing at 8:05 pm, start the regular Town Board meeting at by Councilperson Jeff Gonzalez, seconded by Jim Garraghan, motion carried. 7] Comments or Concerns: Supervisor Tompkins asked if there are comments from the floor, there were none. The Town Attorney Tal Rappleyea stated the 5 standards for zoning determination in the process we do not have zoning, but this is in Town Law 267B which has 5 options that could help when considering a variance. Supervisor Tompkins asked the Board their thoughts on the Clark proposed variance at 115 North Settlement Road. Councilman John Mattice asked if they owned the adjacent property next to this property as stated at the prior meeting. Joseph Clark owns it, but Ms. Moloney does not. Supervisor Tompkins said that the object is to move the septic back as far as they can, he said we need exact footage for our variance. The Town Engineer will process the designs and footage. Supervisor Tompkins asked the board what they wanted to do. A motion by Councilperson James Garraghan, seconded by Councilperson Jeff Gonzalez – to approve the septic with moving it back from original design. The Sign and flower bed were measured, it is not the correct distance from the center of the road required as per the Town Attorney. It is not twenty-five feet from the center of the road. This is not the responsibility of the town to repair it. The discussion of the culvert which has a portion of a garage building built on the pipe- built prior to building ordinances, codes, or laws. Being full time employees, they receive benefits at full time status. Budget 2025: The Board discussed and reviewed several line items in preparation of the 2025 budget. Dawn stated she would check her deed files she may have something for Tal the town attorney. 13] Update of the Records room and Ambulance Quarters: The Supervisor said he has been in contact with a Mr. Petro and Garzone regarding AC / heat and plumbing. Also getting a price on windows and doors. For Information and review: 14] Selective Insurance Company of America: Northeast Region Government Entity, Volunteer Fire Organization of Private School Pool Dividend. The Town received a check in the amount of $1980.88. 15] Ambulance Donation: Mr. & Mrs. Wagner of Campbell Road gave a donation to our Ambulance with a note of appreciation to everyone. 16] Windham Foundation Donation to the Minekill Program: Phyllis Parrish of the Windham Foundation Board gave a donation of $500.00 to the swim program which covers our neighboring towns. The board members were very pleased for this generous donation, which helps our program. 17] CWT Election Results: A list of the election results was given of all the counties involved for review. Updates on ongoing matters: Magda Lane: The final work has been completed we are waiting on the Engineer to inspect this week. Joe Clark variance for septic: Mr. Clark has decided not extend the septic to his other parcel. The engineers will have go back to the drawing board to find a solution.
