TOWN BOARD RESOLUTION OF 2009
NOVEMBER 9, 2009
At the Town Board meeting on November 9, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.
WHEREAS; there are certain residents within the Town of Ashland who have voiced a need to have a place for our children to go to within the Town of Ashland, and
WHEREAS; the Town Board of the Town of Ashland has heard the opinions and concerns of these individuals, and
WHEREAS; some residents of the Town of Ashland are desirous of constructing a park or recreation area for our children
WHEREAS; the Town Board of the Town of Ashland has granted permission for a committee to make recommendations for this project, and
WHEREAS; the Town Board of the Town of Ashland realizes that a committee will be necessary to study the project and to search for a location for the proposed park or recreational location.
THEREORE, BE IT RESOLVED; that the Town Board of the Town of Ashland grants permission for a committee to be formed to search for property for a proposed park and to make a list of recommendations to the Town Board, and
LET IT BE FURTHER RESOLVED; that the committee will consist of the following individuals:

Patricia Ferris, Member

RESOLUTION #47
TOWN OF ASHLAND
TOWN BOARD RESOLUTION OF 2009
NOVEMBER 9, 2009
At the Town Board meeting on November 9, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.
WHEREAS; the GCSWCD has performed stream corridor assessments to support development of a stream management plan for the Batavia Kill stream corridor; and
WHEREAS; the West Ashland stream reach was identified as a priority for restoration in the Batavia Kill Stream Management Plan; and
WHEREAS; a variety of studies and assessments need to be performed on the site to support restoration design; and
WHEREAS; GCSWD and their project partners need to undertake design development activities on certain parcels of privately-owned real property of which the Property is one such parcel; now
WHEREAS; in consideration of the premises and the respective representations hereinafter contained, the parties hereto agree as follows:
- The Landowner hereby grants to the GCSWCD, its employees, agents, contractors and subcontractors, and the New York City Department of Environmental Protection, its employees and agents a temporary license to enter the Property to undertake field operations for the following purposes; assessment and study of site conditions to support restoration design development.
- This license shall commence upon signature by the parties hereto and terminate upon receipt by Landowner of notice from GCSWCD that all necessary field operations have been completed but in no event later than September 30, 2010.
- The GCSWCD shall not be held liable for any personal injury or property damage that results from work performed in conjunction with the Project unless such injury or damage results from the negligence or willful misconduct directly attributed to the GCSWCD its employees, agents or assigns.
- The Landowner shall not be held liable for any personal injury that results from work performed in conjunction with the Project unless such injury or damage results from the negligence or willful misconduct directly attributed to the landowner.
- Neither the City of New York (City) nor the New York City Department of Environmental Protection (DEP) shall be liable to the landowners for any personal injury or property damage that results from work performed in connection with the project unless such injury or damage results from the negligence or willful misconduct directly attributable to acts of the City or DEP, their employees, servants, and/or agents. Both the City and DEP shall be entitled to rely upon the foregoing language and enforce this provision as it either were a signatory hereto.
WHEREAS; The Town Board of the Town of Ashland will grant permission to the Town Supervisor, Richard E. Tompkins, to sign this agreement as presented;
NOW, THEREFORE, BE IT FURTHER RESOLVED; the Town Board of the Town of Ashland has granted permission for Town Supervisor, Richard E. Tompkins, to sign the “West Ashland” Stream Restoration Project LANDOWNER TEMPORARY LICENSE AGREEMENT as the representative for the Landowner, SBL# 93.00-2-7.
