A Public Hearing was held at the Town Hall, 12094 Route 23, Ashland, New York on the13th day of July 2009.
Councilman Robert Ferris opened the Public Hearing for Pedrick at 7:30 pm. Councilman Ferris stated the Supervisor would be arriving shortly.

NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board of The Town of Ashland, Greene County, New York at the Town Hall, Ashland New York on July 13th. at 7:30PM in the evening for the purpose of considering the application of Rich Pedrick for a set back variance from the Town of Ashland’s structure Ordinance for a deck within the minimum 40 foot set back located at 731 Sutton Hollow Road, Ashland, New York. All persons interested in the matter will be heard at such time and place.
Councilman Ferris asked Mr. Pedrick if he had sent and received the Postal Return receipts from all six neighbors boarding his property. Mr. Pedrick gave the receipts to the Board, for the Town Clerk. Mr. Pedrick stated only one neighbor Richard Lucas had called him to ask what the card and notice were for.

Supervisor Richard Tompkins arrived at the Public Hearing at 7:42pm
The Board asked to see the drawings, footage and location of the deck to verify the footage. After a discussion and review of the distance from the road, and the location from the edge of the road to of the proposed deck with no one present to oppose the variance.
MOTION; A motion was made by Councilman Blanden to approve the Pedrick Variance, seconded by Councilman Lawrence, motion was:

At the meeting of the Town Board on July 13, 2009 the above referenced appeal was considered on your request for:
( ) An interpretation of a Town Law
( ) A subdivision of land under the Town Subdivision Law
(X) A variance from the requirements of a Town Law
This notice and the application upon which the action was based are hereby filed with the Town Clerk.
ACTION TAKEN: The following resolution was passed in regards to this application.
RESOLUTION: In the appeal of Jean Pedrick for a setback ordinance variance on the subject matter premises, the applicant’s wish is to construct a deck on their premises located at 731 Sutton Hollow Road, Ashland, New York which is proposed to be within the 40’ setback required by the Ashland Structure Ordinance.
FINDINGS:
The Ashland Structure Ordinance requires a minimum set back of 40’.
The applicant’s wish is to construct a deck on their premises located at 731 Sutton Hollow Road, Ashland, New York which is proposed to be within the 40’ setback required by the Ashland Structure Ordinance. There appears to be no appropriate alternative locations on the property to place the residence.
There were no objections from any adjoining landowner or member of the public.
BASED UPON THE ABOVE FINDINGS THE BOARD REASONS THAT:
The difficulty is not self-created and the lack of granting the variance will result in an undue hardship to the applicants.
Alternative feasible methods to achieve the benefit sought with less or no variance were explored and are not available.
The variance is insubstantial.
It is believed that the variance will not be a detriment to the nearby properties because there were no objections from adjoining landowners to the variance.
An undesirable change will not occur in the character of the neighborhood as a result of the variance.
The variance will not cause adverse effects on the physical or environmental resources of the neighborhood.
The Board took the required “hard look” at the project with regard to the requirements of the NYS Environmental Quality Review Act and found that this action is a Type 2 action and thus is exempt from such requirements and that even if it were not so exempt, the Board would make a “negative declaration” following the submission and review of an Environmental Assessment Form.
The Board voted unanimously to grant the within variance.
The required notice of the hearing was published at least ten (10) days prior to the hearing in the official paper of the Town.
Therefore, the benefit to the applicant as weighed against the detriment to the health, safety and welfare of the neighborhood and community balances in favor of granting the variance.

COMMENTS FROM THE FLOOR
Gary Marron wanted to speak to the board regarding his septic location at his property. He is in need of a variance for the septic which is now in the parking lot. He would like to move the primary field closer to the property line. He said it would be tough the way it is set up now. He spoke to his neighbor Garry Tompkins and he is agreeable to it- He also spoke with the woman at DEP. She seemed agreeable to this design as well
MOTION-A motion was made by Councilman James Lawrence, to have a public hearing on August 10, 2009 at 7:30 pm for a variance for Marron , motion was seconded by Councilperson Wanda Partridge, motion was:

LETTER OF RESIGNATION- Blaine Partridge sent a letter to the Board. Supervisor Tompkins read the letter. The Board accepted his resignation with regret.

An application from Kathy Aplin for board member was read and discussed. A motion was made by Councilman Martin Blanden and seconded By Councilman James Lawrence to accept Kathy Aplin as a Board of Assessment Review member.

TOWN BOARD RESOLUTION OF 2009
JULY 13, 2009
At the Town Board meeting on July 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.
To authorize the Supervisor to use $1,350.00 of Unappropriated Fund balance accounts in the General Fund for 2009 as per General Fund Resolution # 28 of 2009.
Also, to adjust the budget, the Town Board has increased revenues in the Appropriated Fund Balance Account, and also increased the Appropriation Account for the expense in the amount mentioned above.
A motion to adopt this resolution was made by Councilperson, Martin D. Blanden and seconded by Councilperson, Wanda Partridge.

AMBULANCE WRITE OFFS- ACCOUNTING SHEETS
The Board went over the accounting sheets for the Ambulance, all members signed the paperwork.
COALITION OF WATERSHED TOWNS
The Ballet received was read by the Board, after a discussion and review of the ballot.
A motion for the Supervisor to approve this ballot was made by Councilman Ferris to leave the member listed on the form. This was seconded by Councilman Lawrence.

THANK YOU -A Letter of thanks from the Ashland Historical Association was read, by the Board.
DEP LAND ACQUISITION –The Board read over the information re: the land acquired by DEP. They requested that the Planning Board check for the location of the Evergreen Sub-Division road which did not seem to be present on the maps DEP sent.
INTERMUNICIPAL AGGREEMENT between Prattsville and Ashland, The Board met with Erik Allan Highway Superintendent- After a lengthy discussion with Erik Allan as to the terms of the contract and issues within the contract, the Board decided to Table the contract until the next regular board meeting.
TOWN OF ASHLAND POLICY BOOK
The Supervisor handed the book to the members he stated that we need to have the policy in place, as per the Insurance Company. He asked that the Board read it, so that the Town Board can move on it.
HEALTH PLAN PROPOSAL- A proposal was given to the Town from an insurance company. It was given to Councilman Lawrence to go over and review.
MULTI-JURISDISTIONAL ALL NATURAL HAZZARD MITIGATION PLAN
