DISABLITY-LOW INCOME

TOWN BOARD RESOLUTION OF 2009

JANUARY 12, 2009

At the Town Board meeting on January 12, 2009,
Councilperson, Richard E. Tompkins, offered the following resolution and moved its adoption.

WHEREAS, the Town Board of the Town of Ashland has determined that it is appropriate to make available to certain residents of the Town of Ashland an exemption for the purpose of paying real property taxes based on such landowners who are Senior citizens with low income and landowners who are disabled with low income,  

WHEREAS, the Town Board of the Town of Ashland should consider using a sliding scale for the determination of exemption percentages based on low income for the purpose of paying real property taxes based,

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ashland hereby authorizes the Assessor for the Town of Ashland to establish an exemption for the purpose of paying real property taxes, based upon a qualified Senior citizen with low income and landowners who are disabled with low income based on a sliding scale of between Nineteen Thousand Dollars ($19,000.00) and Twenty Four Thousand Nine Hundred Ninety Nine Dollars. ($24,999.00).

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the sliding scale exemptions will be as follows: 
Maximum Income Limit up to $19,000.00 = 50%
$19,000.01 - $19,999.99 = 45%
$20,000.00 - $20,999.99 = 40%
$21,000.00 - $21,999.99 = 35%
$22,000.00 - $22,999.99 = 30%
$23,000.00 - $23,999.99 = 25%
$24,000.00 - $24,999.00 = 20%

A motion to adopt this resolution was offered from Councilperson, James Lawrence and seconded by Councilperson, Martin D. Blanden.  Motion Carried..

ESTABLISHING THE ASHLAND SEWER DISTRICT

TOWN BOARD RESOLUTION OF 2009

RESOLUTION ESTABLISHING THE ASHLAND SEWER DISTRICT
IN THE TOWN OF ASHLAND

On a motion by Robert C. Ferris, seconded by James Lawrence, the following
resolution was adopted:

A resolution having been adopted by the Town Board of the Town of Ashland, New York (the "Town") on September 8, 2008, the Town Board of the Town of Ashland, New York (the "Town"), duly adopted a resolution accepting and adopting the materials needed for the formation of the Sewer District, including a description of the proposed district, reciting that the cost of the formation of the Sewer District will be fully subsidized by the City of New York and directing a copy of the Engineer's Report and Plan, Service Area Map and a detailed explanation of the costs to each residential and non-residential landowner to be placed in the Town Clerk's office and made available for public inspection, and specifying that said Town Board shall meet at 12094 NYS Route 23, Ashland, New York, on the 14th  day of October, 2008 at 7:45 p.m.,
for the purpose of conducting a public hearing on such proposal to establish the Sewer District with the specified improvements and to hear all persons interested in the subject thereof concerning the same, and a hearing having been duly held by said Board at such time and place, and it having been duly resolved and determined following such hearing that the notice of hearing was published and posed as required by law and otherwise sufficient, that all the property owners within the proposed district were benefited thereby, that all property owners benefited were included within the limits of the proposed district, and that it was in the public interest to grant in whole the relief sought, and it having been further duly resolved that the establishment of such district as proposed be approved, subject to permissive referendum in the manner provided in Town Law Article 7, and a certificate of the Town Clerk having been filed pursuant to Town Law 209-e(4), certifying that no petition was filed requesting such a referendum, and the permission of the State Comptroller not being required pursuant to Town Law 209-f, it is hereby

                ORDERED, that a Sewer District be established in the Town to be designated as the Ashland Sewer District of the Town and to be the following description and boundaries as set forth in Exhibit A, and it is further

ORDERED, that the Town Clerk is hereby authorized and directed to cause a certified copy of this order to be duly recorded in the Office of the Clerk of Greene County in which the Town is located, within ten (10) days after the adoption of this order, and it is further

                ORDERED, that the Town Clerk is hereby authorized and directed to file a certified copy of this Order with the New York State Comptroller's Office, Albany, New York, within ten (10) days after the adoption of this order.

BOARD MEETINGS ON THE SECOND MONDAY OF THE MONTH

STORM WATER RETROFIT PROGRAM

ALL HAZARDS MITIGATION PLAN
Highway superintendent Eric Allan has a lot of questions for the all Hazards Mitigation plan.  Eric is to call Supervisor Richard Tompkins during the week to go over them.

COMMUNICATIONS
Proposed Amendments to the NYC Watershed Regulations

HIGHWAY DEPARTMENT BUILING DESIGN
Supervisor Richard Tompkins would like Delaware Engineering to look at the highway department, Tompkins to talk to John Brust about plans.

WASTEWATER PLANT DESIGN
Board is considering adding on a 20x30 L shaped addition to the wastewater treatment plant, the cost would be billed to the Town.  Councilman Martin Blanden will go to the Windham plant to check the size of there room, and Supervisor Richard Tompkins will talk to John Brust from Delaware engineers.  Supervisor will also meet with Allen Tavenner and Delaware engineers about the water well.

TOWN CLERK MONTHLY REPORT
Supervisor Tompkins signed the Town Clerk Monthly report for December 2008.
