PUBLIC HEARING
March 26, 2008

TOWN OF ASHLAND GREENE COUNTY NEW YORK NOTICE OF PUBLIC HEARING ON THE APPLICATION BY DEWALD FOR A VARIANCE

NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board of the Town of Ashland, Greene County, New York at the Town Hall, Ashland, New York on March 26, 2008 at 7:30 pm in the evening for the purpose of considering the application of Larry and Collette DeWald for a setback variance from the Town of Ashland’s Structure Ordinance for a garage within the minimum 40 foot setback located at 12186 Route 23 Ashland, New York.

A Public Hearing was held at the Town Hall, 12094 Route 23, Ashland, New York on the 26th day of March 2008.

Supervisor Richard Tompkins opened the Public Hearing at 7:38 pm.

DEWALD VARIANCE

Attended by: Thomas Soule, Sondra Clark, Kathy Kelly for Rick Corsie, Larry and Colette Dewald.

Larry and Colette Dewald gave the clerk 4 return receipts mailed out on March 5, 2008.
Mr. Dewald is looking to put up a 4 car garage 25 feet from the sidewalk on Route 23 in Ashland and is in need of a variance.

All persons desiring to be heard, having been heard, the hearing was terminated at 7:43 pm.

MOTION-A motion was made by Councilman Robert Ferris to close the public hearing at 7:43 pm, seconded by Councilman Martin Blanden.

Supervisor Tompkins would like to put Dewald’s on the agenda for the April 14, 2008 Town Board Meeting.

KATHY KELLY FOR RICK CORSIE
Kathy Kelly addressed the board for Rick Corsie about a piece of property on Carrington Road that he would like to build on.  She was advised to contact the planning board and also the building code enforcer. Property is 93.02-2-28.

SONDRA CLARK PLANNING BOARD ISSUES
Sondra Clark told the board about the 2nd Annual Batavia kill Stream Festival is scheduled for August 9, 2008 with a rain date of August 10, 2008 and if the town had put money in the budget to help fund this event.  Board thought that they have and will check into it.

PLANNNING BOARD MEMBER ABSENCES
Sondra Clark expressed that John Mattice Jr. is a planning board member and has not shown up for several meetings and would like to know what can be done.  Supervisor Richard Tompkins spoke to Town Attorney Tal Rappleyea, and was told that he can resign but we can’t make him.  Councilman James Lawrence told the board that he will talk to him.  Supervisor Richard Tompkins left the meeting for a moment and upon his return he had just spoken to John Mattice Jr. and John told him that he would hand in his resignation.

BEAUTIFICATION AND CLEAN UP WEEK
The Town will once again have a week that the highway department will pick up garbage on the side of the road.  People will have to call and make an appointment with Diane Cross.  No house hold garbage will be accepted.  Clean up will be the week of May 19-23.

 

SONDRA CLARK PLANNING BOARD ISSUES ON RTE 10 & 32C
Sondra Clark addressed the board about the problems on County Route 32C, Megerle property.  Clerk gave Clark copy of letter from Town Attorney Tal Rappleyea regarding subdivision, roadway and drainage issues that are not in accordance with the Town approval and the Town Subdivision Law.  Supervisor Richard Tompkins advised Sondra Clark to contact Tal Rappleyea and the County Clerk on this matter.
Property of Milton Petrou on County Route 10. Town Clerk gave Clark letter from Town Attorney Tal Rappleyea and was also advised to contact Tal Rappleyea with her concerns.  Planning Board would like to be on the next town board on April 14, 2008.

 

Motion was made by Councilperson Wanda Partridge to close the meeting at 8:52 pm.
