Notice is hereby given, that a public hearing will be held by the Town Board of the Town of Ashland, Greene County, New York at the Town Hall, Ashland, New York which is accessible to persons with disabilities, on April 13, 2009 at 7:30 pm in the evening for the purpose of providing information and receiving public comment on funding for a proposed public water supply in the hamlet of Ashland.  The public is encouraged to attend and may submit comments either at the meeting or in writing to the above address.

The Town is beginning to prepare an application for a $600.000 Community Development Block Grant which would be used to construct a public water supply system.

Public Hearing opened at 7:35 pm.

MOTION-A motion was made by Councilman Robert Ferris to have a Public Hearing for the water district on April 22, 2009 at 7:30 P.M., seconded by Councilman James Lawrence, motion was:

NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board of the Town of Ashland, Greene County, New York at the Town Hall, Ashland, New York on April 13, 2009 at 7:30 pm in the evening for the purpose of considering the application of the Town of Ashland for a setback variance from the Town of Ashland’s Structure Ordinance, for an addition to the town hall within the minimum 40 foot setback located at12094 Route 23 Ashland, New York.

ALL persons interested in the matter will be heard at such time and place specified. 

Public Hearing was opened at 7:55

With all having been heard the public hearing was closed.

PUBLIC WATER PROJECT

DESIGNATION OF LEAD AGENCY FOR SEQR

APRIL 13, 2009

At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.

WHEREAS; by resolution dated February 9, 2009, the Town Board sought lead agency status for a project to construct a new public water supply system
(Hereafter, the “Project”); and

WHEREAS; each involved agencies were notified by letter of the Town’s request and provided with copies of Part I of the environmental assessment from for the Project; and

WHEREAS; thirty days has passed since the notification and no agency has disputed the Town’s lead agency status; and

NOW, THEREFORE, in consideration of the foregoing:

The Town Board declares itself to be lead agency for the environmental review of the Project.

The Supervisor will cause all involved agencies to be notified of this resolution.

This resolution will take effect immediately.

A motion to adopt this resolution was made by Councilperson, Robert C. Ferris and seconded by Councilperson, Wanda Partridge.

TOWN BOARD RESOLUTION OF 2009

PUBLIC WATER PROJECT

SEQR NEGATIVE DECLARATION

APRIL 13, 2009

At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.

WHEREAS, by resolution dated February 9, 2009, the Town Board sought lead agency status for a project to construct a new public water supply system (hereafter, the “Project”); and

WHEREAS, by resolution dated April 13, 2009, the Town Board designated itself as lead agency for this; and

WHEREAS, the Town has conducted a review as required by Article 8, Part 617 of the Environmental Conservation Law (SEQR) as documented by the attached Negative Declaration; and

WHEREAS, based on this review, the Town has determined no adverse environmental impacts would result from this Action.

NOW THEREFORE, in consideration of the foregoing:

The Supervisor will cause all involved agencies to be notified of this resolution.

This resolution will take effect immediately.

The Town Board adopts the SEQR Negative Declaration attached hereto.

TOWN BOARD RESOLUTION OF 2009

APRIL 13, 2009

At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.

WHEREAS, the Town Board of the Town of Ashland has heretofore determined that the establishment of a public water supply and district is necessary for the public safety and welfare of the Town; and

WHEREAS, the Town Board held a public hearing on the 9th of March 2009 in accordance with Section 209-c of the NYS Town Law, and

WHEREAS, the Town Board of the Town of Ashland adopted an Order in Accordance with the said Section 2509-c of the NYS Town Law on the 9th day of March 2009.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ashland hereby finds and determines based upon the evidence received during such public hearing that

the notice of the abovementioned public hearing which occurred on the 9th day of March 2009 was published in the official newspaper of the Town and posted as required by law and is otherwise sufficient;

each of the properties and property owners within the proposed district are benefited by the establishment of the proposed public water supply and district;

each property and property owner benefited by the proposed district are included within the limits of the district; and

The establishment of such district is in the public interest.

A motion to adopt this resolution was made by Councilperson, James Lawrence and seconded by Councilperson, Robert C. Ferris.

TOWN BOARD RESOLUTION OF 2009

APRIL 13, 2009

At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.

WHEREAS, the Town Board of the Town of Ashland has heretofore determined that the establishment of a public water supply and district is necessary for the public safety and welfare of the Town; and

WHEREAS, the Town Board held a public hearing on the 9th of March 2009 in accordance with Section 209-c of the NYS Town Law, and

WHEREAS, the Town Board of the Town of Ashland adopted an Order in Accordance with the said Section 2509-c of the NYS Town Law on the 9th day of March 2009.

WHEREAS, the Town Board has found in the affirmative that all requirements of Section 209-e (1) of the NYS Town Law has been satisfied.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ashland hereby finally approves the establishment of the water district with the boundaries being determined as set forth in the notice for the public hearing and Order and attached hereto as Schedule “A”, and it is further

RESOLVED, that the permission of the NYS Comptroller is not required for the within action since all matters herein are consistent with the requirements of Section 209-f of the NYS Town Law, and it is further

RESOLVED, that this resolution shall be subject to a permissive referendum.

HIGHWAY SUPERINTENDENT-BLACK-TOP
Highway superintendent would like to blacktop Biegel road with an estimate of $131,363.00, discussion was had with the board.

SENIOR PROJECT-JOSH SUTTON
WAJCS senior Josh Sutton would like use of the town hall as a drop off site for the collection of unused computers.
MOTION-A motion was made by Councilman Robert Ferris for Josh Sutton to be in the town hall building on April 25 & 26 between 10:00-3:00 for anyone to drop off unused computers for his senior project, seconded by Councilman James Lawrence, motion was:

PRE REGISTER – PRE TRAVEL EXPENSES

At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins
Offered the following resolution and moved its adoption.
Due to the fact that continuing education is required for some elected officials as well as EMT certification through the New York State Pilot Program, it may be necessary to pre-register applicants and pre-pay travel expenses for the continuing education needed to maintain their certifications.  This resolution authorizes the Town Board of the Town of Ashland to pre-approve the registrations and travel expenses in order to allow Town Officials as well as EMTs to reserve their spot for their annual conferences.

APRIL 13, 2009

At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption.

To authorize the Supervisor to use $9,228.85
of Unappropriated Fund Balance to balance accounts in the General Fund for 2009 as per General Fund Resolution #4 of 2009.

Also, to adjust the budget, the Town Board has increased revenues in the Appropriated Fund Balance Account, and also increased the Appropriation Account for the expense in the amount mentioned above.

To authorize the Supervisor to establish the following checking accounts entitled:

General Fund, Recreation Fund, Highway Fund, Landfill Closure, Street Lighting, Capital Reserve Fund Matching Water Funds, Ambulance Service, Watershed, General Capital Reserve Fund, Building and Property, Highway Capital Reserve, Trust & Agency and West Settlement Cemetery.

WASTE WATER TREATMENT PLANT
Board would like to discuss an addition to the waste water treatment plant, they would like to add windows and maybe some stone work three feet up the building and vinyl siding.
