TOWN OF ASHLAND Richard E. Tompkins, Town Supervisor PUBLIC HEARING A Public Hearing was held at the Town Hall, 12094 Route 23, Ashland, New York on the13 th day of April 2009. Present
Attended by: Pledge of Allegiance Town Clerk, Justine L Koehler read the notice The Town is beginning to prepare an application for a $600.000 Community Development Block Grant which would be used to construct a public water supply system. Public Hearing opened at 7:35 pm. MOTION-A motion was made by Councilman Robert Ferris to have a Public Hearing for the water district on April 22, 2009 at 7:30 P.M., seconded by Councilman James Lawrence, motion was: All questions and comments having been heard. MOTION-A motion was made by Councilman Robert Ferris to close the public hearing at 7:55 P.M., seconded by Councilman James Lawrence, motion was: Town Clerk Justine L Koehler read the notice ALL persons interested in the matter will be heard at such time and place specified. Public Hearing was opened at 7:55 With all having been heard the public hearing was closed. MOTION-a motion was made by Councilman James Lawrence to close the public hearing at 8:04 pm, seconded by Councilman Robert Ferris, motion was: RESOLUTION #15 TOWN OF ASHLAND TOWN BOARD RESOLUTION OF 2009 PUBLIC WATER PROJECT DESIGNATION OF LEAD AGENCY FOR SEQR APRIL 13, 2009 At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption. WHEREAS; by resolution dated February 9, 2009, the Town Board sought lead agency status for a project to construct a new public water supply system WHEREAS; each involved agencies were notified by letter of the Town’s request and provided with copies of Part I of the environmental assessment from for the Project; and WHEREAS; thirty days has passed since the notification and no agency has disputed the Town’s lead agency status; and NOW, THEREFORE, in consideration of the foregoing: The Town Board declares itself to be lead agency for the environmental review of the Project. The Supervisor will cause all involved agencies to be notified of this resolution. This resolution will take effect immediately. A motion to adopt this resolution was made by Councilperson, Robert C. Ferris and seconded by Councilperson, Wanda Partridge. ADOPTED:

RESOLUTION #16-09 TOWN OF ASHLAND TOWN BOARD RESOLUTION OF 2009 PUBLIC WATER PROJECT SEQR NEGATIVE DECLARATION APRIL 13, 2009 At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption. WHEREAS, by resolution dated February 9, 2009, the Town Board sought lead agency status for a project to construct a new public water supply system (hereafter, the “Project”); and WHEREAS, by resolution dated April 13, 2009, the Town Board designated itself as lead agency for this; and WHEREAS, the Town has conducted a review as required by Article 8, Part 617 of the Environmental Conservation Law (SEQR) as documented by the attached Negative Declaration; and WHEREAS, based on this review, the Town has determined no adverse environmental impacts would result from this Action. NOW THEREFORE, in consideration of the foregoing: The Supervisor will cause all involved agencies to be notified of this resolution. This resolution will take effect immediately. The Town Board adopts the SEQR Negative Declaration attached hereto. A motion to adopt this resolution was made by Councilperson, Robert C. Ferris and seconded by Councilperson, Wanda Partridge. I certify that the above resolution adopted by the Ashland Town Board on April 13, 2009 is a true and correct transcript of the original now on file in this office ____________________________________ RESOLUTION #17-09 TOWN OF ASHLAND TOWN BOARD RESOLUTION OF 2009 APRIL 13, 2009 At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption. WHEREAS, the Town Board of the Town of Ashland has heretofore determined that the establishment of a public water supply and district is necessary for the public safety and welfare of the Town; and WHEREAS, the Town Board held a public hearing on the 9th of March 2009 in accordance with Section 209-c of the NYS Town Law, and WHEREAS, the Town Board of the Town of Ashland adopted an Order in Accordance with the said Section 2509-c of the NYS Town Law on the 9th day of March 2009. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ashland hereby finds and determines based upon the evidence received during such public hearing that the notice of the abovementioned public hearing which occurred on the 9th day of March 2009 was published in the official newspaper of the Town and posted as required by law and is otherwise sufficient; each of the properties and property owners within the proposed district are benefited by the establishment of the proposed public water supply and district; each property and property owner benefited by the proposed district are included within the limits of the district; and The establishment of such district is in the public interest. A motion to adopt this resolution was made by Councilperson, James Lawrence and seconded by Councilperson, Robert C. Ferris.
ADOPTED: I certify that the above resolution adopted by the Ashland Town Board on April 13, 2009 is a true and correct transcript of the original now on file in this office ____________________________________ RESOLUTION #18-09 TOWN OF ASHLAND TOWN BOARD RESOLUTION OF 2009 APRIL 13, 2009 At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption. WHEREAS, the Town Board of the Town of Ashland has heretofore determined that the establishment of a public water supply and district is necessary for the public safety and welfare of the Town; and WHEREAS, the Town Board held a public hearing on the 9th of March 2009 in accordance with Section 209-c of the NYS Town Law, and WHEREAS, the Town Board of the Town of Ashland adopted an Order in Accordance with the said Section 2509-c of the NYS Town Law on the 9th day of March 2009. WHEREAS, the Town Board has found in the affirmative that all requirements of Section 209-e (1) of the NYS Town Law has been satisfied. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ashland hereby finally approves the establishment of the water district with the boundaries being determined as set forth in the notice for the public hearing and Order and attached hereto as Schedule “A”, and it is further RESOLVED, that the permission of the NYS Comptroller is not required for the within action since all matters herein are consistent with the requirements of Section 209-f of the NYS Town Law, and it is further RESOLVED, that this resolution shall be subject to a permissive referendum. A motion to adopt this resolution was made by Councilperson, Robert C. Ferris and seconded by Councilperson, Wanda Partridge. RESOLUTION #4-09 TOWN OF ASHLAND GENERAL FUND RESOLUTION OF 2009 APRIL 13, 2009 At the Town Board meeting on April 13, 2009Councilperson, TRANSFER FROM TRANSFER TO Ambulance Contr. Misc. Ambulance - Postage A motion to adopt this resolution was offered by Councilperson, James Lawrence and seconded by Councilperson, Wanda Partridge. Motion carried.

TOWN OF ASHLAND TOWN BOARD RESOLUTION OF 2009 APRIL 13, 2009 At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption. To authorize the Supervisor to use $9,228.85 Also, to adjust the budget, the Town Board has increased revenues in the Appropriated Fund Balance Account, and also increased the Appropriation Account for the expense in the amount mentioned above. TOWN OF ASHLAND TOWN BOARD RESOLUTION OF 2009 APRIL 13, 2009 At the Town Board meeting on April 13, 2009, Councilperson, Richard E. Tompkins offered the following resolution and moved its adoption. To authorize the Supervisor to establish the following checking accounts entitled: General Fund, Recreation Fund, Highway Fund, Landfill Closure, Street Lighting, Capital Reserve Fund Matching Water Funds, Ambulance Service, Watershed, General Capital Reserve Fund, Building and Property, Highway Capital Reserve, Trust & Agency and West Settlement Cemetery. A motion to adopt this resolution was made by Councilperson, Robert C. Ferris and seconded by Councilperson, Wanda Partridge. ADOPTED: ____________________________________ COMMUNICATIONS TOWN CLERK MONTHLY REPORT O & M AGREEMENT Supervisor Richard Tompkins left the room at 9:05. MOTION-A motion was made by James Lawrence to grant Donald Tompkins two extra connections for the sewer line and he will sign easement agreement, seconded by Councilperson Wanda Partridge, motion was: Supervisor Richard Tompkins returned at 9:08. WASTE WATER TREATMENT PLANT MINUTES FOR MARCH 2, 2009, MARCH 9, 2009 AND MARCH 26,2009 PAY THE BILLS MOTION –A motion was made by Councilman Robert Ferris to pay the bills as written, seconded by Councilman James Lawrence, motion was: Councilperson Wanda Partridge closed the meeting at 9:50 pm.
